1. IDENTIFYING INFORMATION

ELIS ELIS is the owner of the www.eliselis.com website.

2. OBJECT

The purpose of this document is to establish the General Conditions of Use and Access to the “eliselis.com” Web Portal and the responsibilities arising from the use of its contents, which include, for example, images, software and texts; trademarks and logos, structure and design, access and use.

Any person accessing and/or using the eliselis.com shop shall have the status of user or “member” (registered user).

3. CONDITIONS OF ACCESS AND USE OF THE SHOP

3.1. CLASSIFICATION AS A USER (USER NOT REGISTERED AS A MEMBER)

eliselis.com allows users to access the content offered by ELIS ELIS free of charge.

This website is for personal, non-commercial use. It is not permitted to use this website or any of its contents for commercial purposes or to include advertising on another website without having received prior written authorization from ELIS ELIS.

3.2. REGISTRATION REQUIREMENT

As a general rule, it shall not be necessary to register as a user in order to access the general services. However, the use of certain Services may be subject to prior registration by the user, providing certain personal data necessary to be able to access the aforementioned services.

This registration shall be carried out in the manner expressly indicated in the service itself. In these cases, the provisions of the “Privacy Policy” shall apply.

The user guarantees the authenticity and accuracy of the personal data provided, undertaking to keep them duly updated at all times.

The user undertakes to use his/her user name and password correctly. The user will be responsible for all actions carried out with his/her user name. The user shall close the session at the end of the session.

The services offered to the user through the shop are generally free of charge, except in the case of the purchase of an article or service online.

3.4. USE OF THE SHOP AND ITS SERVICES

The user acknowledges and accepts that the use of the content and/or services offered by the store is at the user’s own risk and/or under the user’s sole responsibility.

The user undertakes to use the shop and all its contents and services in accordance with the law, morality, public order and these General Conditions of Use. The user undertakes not to use them to carry out illicit activities that infringe the rights of third parties and/or infringe intellectual and industrial property regulations, or any other applicable legislation.

The user shall use all the information accessed through this portal (data, contents, texts, photographs, software, etc.) exclusively for his/her own needs, and it is forbidden to use the services or the materials, texts, images and information obtained through the same for commercial purposes, either directly or indirectly.

The user’s obligations are, among others, the following:

i. Not to insert or disseminate content or advertisement of a racist, xenophobic or pornographic nature, or that advocates terrorism or violates human rights.

iii. Not to disseminate, share or make available to third parties any type of information, element or content that violates the fundamental rights and public freedoms recognized in the constitution and in international treaties.

iv. Not to disseminate, share or make available to third parties any type of information, element or content that constitutes unlawful or unfair advertising.

v. Not to share unwanted or unauthorized advertising, promotional material, “junk mail” or any other form of solicitation, except in those areas (such as commercial spaces) that have been exclusively designed for this purpose.

vi. Not to insert or disseminate false, ambiguous or inaccurate information or content for the purpose of misleading the recipients of the information.

vii. Not to impersonate other users by using their passwords to access the different services and/or contents of the portals.

viii. Not to disseminate, share or make available to third parties any type of information, element or content that involves a violation of the intellectual and industrial property rights, patents, trademarks or copyright that correspond to the owners of the portals or to third parties.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

ELIS ELIS, acting on its own behalf or as assignee, is the owner of all the intellectual and industrial property rights of its eliselis.com website, as well as of the contents thereof, belonging to ELIS ELIS or its customers. The user therefore undertakes to respect the intellectual and industrial property rights of eliselis.com.

The user may view the elements of the website and even print them, copy them and store them on the hard disk of his/her computer or on any other physical medium as long as this is solely and exclusively for his/her personal and private use.

The use of the texts, images, advertisements and any other element included on this website for subsequent inclusion, in whole or in part, on other websites is strictly prohibited without the prior written authorisation of ELIS ELIS.

The user acknowledges that all the elements of the shop and each of the services provided through the same, the information, texts and images contained therein, the structure, layout and presentation of the contents and the tools and software used in relation to the same are protected by intellectual and industrial property rights belonging to ELIS ELIS.

Users may not remove the logos identifying the rights (intellectual, industrial or any other type of property) belonging to ELIS ELIS or third parties that appear in the shop and in each of the different services offered through the same.

5. EXCLUSION OF GUARANTEES. LIABILITY

5.1. AVAILABILITY AND CONTINUITY OF THE SHOP AND SERVICES

ELIS ELIS does not guarantee the availability, access and continuity of the operation of the shop and its services.

ELIS ELIS shall not be liable, within the limits established in current legislation, for any damages caused to the user as a result of the unavailability, impossibility of access and lack of continuity of the shop and its services.

5.2. ELIS ELIS’ CONTENTS AND SERVICES

ELIS ELIS shall be solely and exclusively liable for the services it offers itself and for the contents directly inserted by ELIS ELIS. This liability shall be excluded in cases of force majeure or when the configuration of the user’s equipment is not suitable for the correct use of the internet services provided by ELIS ELIS. In any event, ELIS ELIS liability to the user for any reason whatsoever shall be limited to the maximum amount received by ELIS ELIS directly from the user, excluding in all cases liability for indirect damages or loss of profit.

6. PROTECTION OF PERSONAL DATA

Users are hereby informed that, in accordance with the provisions of Spanish Organic Law 3/2018, of 5 December, on Personal Data Protection and the guarantee of digital rights, and the EU Regulation 2016/679 of the European Parliament, of April 27^th 2016, the personal data provided voluntarily by users on the registration form shall be included in a file owned by ELIS ELIS and will only be used for the authorized and communicated reasons.

In accordance with said regulations, ELIS ELIS has adopted the necessary technical and organisational measures to maintain the required level of security in relation to the personal data processed in order to prevent, as far as possible, unauthorised access, theft and loss.

Users have the right to access, rectify and modify their personal data and to unsubscribe from the eliselis.com service. These rights can be exercised through the personal modification of the file, via email to hola@eliselis.com.

Personal data will be kept for the duration of the relationship with the company and in any case for the time needed according to the applicable legal dispositions for the time that is strictly necessary to attend to possible responsibilities due to the treatment of the data.

7. TERMINATION

ELIS ELIS may, immediately and without prior notice, terminate its relationship with the user, suspending their access to the portal or the corresponding services, if it detects inappropriate use of the same or use contrary to the general or specific conditions described in this text.

The user shall be liable for any direct or indirect damages that ELIS ELIS may suffer as a result of breach of any of the obligations arising from the general and specific conditions in relation to the use of the shop or any of the services linked to the same.

The user shall hold ELIS ELIS harmless against any penalty, claim or lawsuit that may be brought by a third party, including any public bodies, against ELIS ELIS, its employees or its agents as a result of the infringement of any third party rights by the user through the use of the store or the services linked to the same in a manner contrary to the provisions of the applicable general or specific terms and conditions.

8. MISCELLANEOUS

8.1 MODIFICATIONS

ELIS ELIS reserves the right to make any modifications it deems appropriate, and may modify, delete and include new content and/or services and modify the way in which they are presented and located.

Likewise, ELIS ELIS reserves the right to modify the terms and conditions of use of the website at any time. Any modification will be published on the website.
